An action was tried in the County Court yesterday, in which Messrs. De Gruchy and Leigh, lithographic printers, sued Jas. Wm. Thomson, owner of the copyright of Meek's Artistic Atlas of Australasia, for the recovery of a sum of £41 10d., balance due upon an account for printing a number of these atlases to his order. In May, 1862, plaintiffs undertook to print some 2,000 copies of the atlas in question for a sum agreed upon, but when the account was rendered, defendant objected to pay the full amount claimed, alleging that he was entitled to a considerable reduction in the price, because some 270 of the copies delivered were so stained with iron mould as to be almost valueless. Plaintiffs now asserted that defendant, having found he had more maps than he could sell, alleged that a number of the copies were damaged simply in order that he might evade his liability, and that the maps were probably injured after they came into Thomson's possession. The Court decided to deduct a sum of ₤16 from plaintiff's claim, this amount including ₤5 which it was admitted defendant should be credited with, and judgment was accordingly given for £25 10s.
